Terms of Service

§ 1 Scope

These Terms govern the use of the LeanStream platform (the web app at leanstream.app and the mobile apps for iOS and Android) between the provider named in the imprint and you as a user. By registering you agree to these Terms.

§ 2 Service description

LeanStream is a platform that lets members of an organisation record, upload, share, and comment on short improvement videos. The feature set may vary; the provider reserves the right to further develop, limit, or discontinue features.

§ 3 Registration and account

Use of the service requires registration with a valid email address. You undertake to provide truthful information and to keep your access credentials confidential. An account is intended solely for personal or organisational use as assigned; it must not be transferred to third parties.

§ 4 Content and user obligations

You are solely responsible for the content you upload or publish. In particular, you warrant that such content does not infringe third-party rights (e.g. copyright, personality or trademark rights) and does not violate applicable law.

The following are prohibited in particular:

  • Content of a violence-glorifying, pornographic, racist, insulting, or otherwise unlawful nature
  • Recordings of persons without their consent (right to one’s own image)
  • Advertising, spam, automated queries, and any attempts to disrupt the platform or reverse-engineer it

§ 5 Rights to content

You retain ownership of the content you upload. You grant the provider a non-exclusive, worldwide, royalty-free licence, limited to the purpose of operating the service (storing, processing, and displaying content within the organisation).

§ 6 Availability

The provider endeavours to maintain the highest possible availability. However, continuous availability cannot be guaranteed; in particular, the service may be temporarily unavailable due to maintenance or failures at third-party providers (e.g. Cloudflare).

§ 7 Account deletion

You can delete your account at any time inside the app under Profile → Delete account or by email to hello@leanstream.app. You will be signed out of all sessions immediately; personal data is permanently deleted 30 days later. Uploaded videos remain in the organisation and are displayed anonymously. See the privacy policy, section 4, for details.

§ 8 Liability

The provider is liable only for wilful intent and gross negligence and for damages resulting from breach of material contractual obligations (cardinal duties); in the latter case, liability is limited to damages that are foreseeable and typical for this type of contract. Liability under the German Product Liability Act (ProdHaftG) and for injury to life, body, or health remains unaffected.

§ 9 Changes to these Terms

The provider may adjust these Terms. Material changes will be announced to you by email or in-app. If you do not object within 30 days of receiving notice, the changes are deemed accepted.

§ 10 Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For contracts with consumers, this choice of law applies only to the extent that it does not deprive the consumer of the mandatory consumer-protection rules of the country in which the consumer has their habitual residence. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
